Acceptance of terms
By creating an account, installing the app, or simply using Ouananiche, you unconditionally accept these terms of use as well as our privacy policy.
If you do not accept these terms, you must stop using the app immediately.
Service description
Ouananiche is a progressive web application (PWA) designed for sport anglers in Quebec. It offers:
- Mapping of water bodies with regulations per zone
- Customizable catch journal
- Bite predictor based on conditions
- Community of fishing reports
- AI assistant "Cyril" for fishing advice
- Species recognition by photo (Scan & Identify)
- Localized fishing weather
- Regulatory alerts (seasons, limits)
Some features are free (with daily limits), others require a PRO subscription.
Account creation
Eligibility requirements
To create an account on Ouananiche, you must:
- Be at least 14 years of age
- Provide a valid email address that belongs to you
- Choose a username and password
- Accept these terms and the privacy policy
Your responsibilities
- Account confidentiality — you are responsible for the security of your password
- Accuracy — the information you provide must be accurate
- One account per person — creating multiple accounts to bypass limits or free trials is prohibited
- Notification — inform us promptly if you suspect fraudulent use of your account
PRO subscription
Plans and pricing
Ouananiche PRO is available under the following plans (taxes included):
- Monthly — CAD $4.99 per month (launch price: CAD $3.99 per month)
- Annual — CAD $30 per year (i.e., $2.50/month, significant savings)
Prices may change. Any changes will be communicated at least 30 days in advance by email. You can cancel before the new price takes effect.
48-hour free trial
Upon account creation, you can benefit from a 48-hour free PRO trial. This trial:
- Is offered once per user
- Does not require a credit card
- Ends automatically after 48 hours, with no automatic conversion to a paid subscription
Payment
Payments are processed securely by Stripe. We never store your full banking information. Accepted methods: credit cards (Visa, Mastercard, Amex), Apple Pay, Google Pay.
Automatic renewal
Your subscription automatically renews at the end of each period (monthly or annual) until you cancel it. You will receive a confirmation email at each renewal.
Cancellation
You can cancel your subscription at any time:
- Directly in the app (Settings › Subscription › Manage › Cancel)
- Or by contacting us at support@ouananiche.ca
Cancellation takes effect at the end of the current period. You retain access to PRO features until then.
Refund policy
Exceptions (consumer rights in Quebec)
In accordance with the Quebec Consumer Protection Act, a refund may be granted in the following situations:
- Service not matching the description — if the app does not provide what is promised in our communications
- Blocking bug preventing use — if a major technical issue prevents us from providing service after diagnosis
- Double billing — in the event of our error
- Cancellation of a distance contract — within 7 days of subscription, provided that you have not yet used the PRO features (article 54.8 CPA)
For any refund request, contact us at support@ouananiche.ca describing the situation. We will respond within a reasonable time.
Code of conduct
Ouananiche aims to create a friendly community of anglers. By using the app, you agree to respect these rules:
What is allowed
- Share your catches, techniques, locations, and tips
- Ask questions, even if they seem basic
- Respectfully correct erroneous information
- Use the app for your personal fishing practice
What is prohibited
- Illegal content — fishing out of season, in restricted areas, without a license, etc.
- Harassment, insults, discrimination — zero tolerance
- Spam or unauthorized advertising — reports and messages must relate to fishing
- Willful false information — misleading the community about a location, species, or conditions
- Unauthorized commercial use — without our written consent
- Hacking or exploitation of vulnerabilities — unauthorized access attempts, injection, reverse engineering
- Automation — bots, scripts, mass scraping of the service
- Protected content — posting content for which you do not hold rights (stolen photos, copied texts)
Intellectual property
What belongs to us
The Ouananiche application, its source code, design, logos, brand, texts, regulatory databases, and all features it contains are the exclusive property of the operator, protected by Canadian and international copyright and intellectual property laws.
You may not copy, reproduce, modify, decompile, distribute, or create derivative works from Ouananiche without our written consent.
What belongs to you
Your catches, photos, reports, spots, and comments you post remain your property.
By posting them on Ouananiche, you grant us a non-exclusive, worldwide, royalty-free license to display, store, and distribute them as part of the service, as well as for promotional use (example: showing a nice anonymized catch in an ad) — only with mention of the username.
This license ends when you delete the content or your account, except for uses already carried out in good faith.
Responses from the AI assistant Cyril
Responses generated by Cyril are for informational purposes only. You may use them for your own personal fishing use. They are neither individually verified nor official.
Important warnings
Limitation of liability
To the fullest extent permitted by Quebec law:
- We are not responsible for indirect, consequential, or unforeseeable damages arising from your use or inability to use Ouananiche
- We are not responsible for the consequences of erroneous information displayed in the app, in particular a violation of fishing regulations
- Our total liability, in the event of judicial recognition, is limited to the total amount you have paid to Ouananiche over the past 12 months
Termination
Termination by you
You can terminate your account at any time:
- Via the app's Settings ("Delete my account" option)
- Or by writing to us at support@ouananiche.ca
Termination by us
We may suspend or delete your account, with or without notice, in the following cases:
- Serious violation of these terms
- Non-payment of a subscription
- Fraudulent or illegal activity
- Prolonged inactivity (more than 24 months) — with email notice
- Our decision to cease service operation
Effects of termination
Upon termination, your access to the service ends. Your data is processed according to the privacy policy (deletion within 30 days, except legal retention obligations).
Modifications to the service and terms
We may:
- Add, modify, or remove features
- Adjust usage limits of free or PRO accounts
- Modify these terms of use
In the event of a significant change, we will notify you by email at least 30 days in advance. Your continued use of the app after the effective date constitutes your acceptance.
Governing law and jurisdiction
These terms are governed by the laws of the Province of Quebec and the applicable federal laws of Canada.
Any dispute arising from the use of Ouananiche will be brought before the competent courts of the judicial district of Saint-François, Province of Quebec, Canada.
